The federal push to override state AI laws hasn't displaced the state chatbot rules

A December 2025 executive order set up a Justice Department task force, launched on 9 Jan 2026, to challenge state AI laws, and the department joined a lawsuit against Colorado's AI Act. In July 2026 the FTC proposed a policy statement suggesting some state AI laws may be preempted. Congress has not passed preemption, and state chatbot and frontier AI laws remain enforceable.
Watch: Keep to each state law's own dates, and don't plan around preemption until a court or Congress acts.
