Texas bans AI built to incite self-harm or produce child sexual abuse material

In force now

ModerateModerate and certain

Since 1 Jan 2026, the Texas Responsible AI Governance Act bars developing or deploying AI with intent to incite self-harm, suicide, violence or crime, or to produce child sexual abuse material or sexual deepfakes of minors. The Attorney General enforces it alone, after a 60-day cure period. Penalties run from $10,000 for an uncured violation to $200,000 for one that can't be cured, plus up to $40,000 a day for continuing ones.

Assess: Document your safeguards against CSAM, sexual deepfakes of minors and self-harm prompts, so you can answer a cure notice within 60 days.

Who it reaches

It reaches generative AI services with users in the US, at any size. Any developer or deployer doing business in Texas.

Lands on Policy & Standards, Legal & Regulatory and Engineering.
